These Terms and Conditions ("Terms") govern your access to and use of tncflipbook.com (the "Site") and the products, plugins, addons, and services offered by ThemeNcode LLC ("ThemeNcode," "we," "our," or "us"). By using the Site or purchasing any of our products, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase from us.
These Terms work alongside two related documents:
- The License Policy sets out the specifics of what each plugin and addon license covers, including site limits, refunds, expiry behaviour, and prohibited use.
- The Privacy Policy describes how we collect, store, and use personal data.

1. Acceptance and eligibility
By accessing tncflipbook.com, creating an account, or purchasing any of our products, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, that you have the legal capacity to enter into a binding agreement, and that you accept these Terms in full.
If you are using the Site or buying products on behalf of a company, organization, or other legal entity, you confirm that you have authority to bind that entity, and "you" in these Terms refers to that entity.
2. About ThemeNcode and our products
ThemeNcode LLC is a Wyoming, US limited liability company. We develop and sell WordPress plugins and related digital products, primarily under the TNC FlipBook brand, directly through tncflipbook.com.
Current products, tiers, and what each one includes are listed on the product pages and in the License Policy.
3. Your account
You can browse tncflipbook.com without an account, but you need one to complete a purchase, download products, manage licenses, or open support tickets. When you create an account you agree to:
- Provide accurate, complete, and up-to-date information.
- Keep your password confidential and not share your account credentials.
- Notify us promptly at cs@tncflipbook.com if you believe your account has been accessed without authorisation.
- Take responsibility for activity that occurs under your account.
We reserve the right to suspend or close accounts that violate these Terms, the License Policy, or applicable law.
4. Purchases, pricing, and billing
All prices are shown in US dollars unless otherwise specified, and exclude any applicable sales tax or VAT, which is calculated and added at checkout based on your billing location.
Payments are processed by trusted third-party payment processors. ThemeNcode does not store full credit card numbers on its own servers; we receive a tokenised reference from the processor used only to charge the original transaction and any agreed recurring renewals. By completing a purchase you agree to the billing terms of the tier you selected at checkout, as described on the product page and in the License Policy.
Promotional pricing, coupons, and discount codes have specific terms displayed at the time of offer. They cannot be combined unless explicitly stated and cannot be applied retroactively.
5. Licensing of our products
Your use of our products is governed by the License Policy, which forms part of this agreement. The License Policy sets out the license grant, site limits, license-key behaviour, expiry, transfers, refunds, support, and prohibited use.
The plugin source code is distributed under the GNU General Public License v2 or later, as required for WordPress plugins. The GPL governs the source code; everything else we provide (updates, support, addon access, license-key validation, our trademarks) is separate from the source and remains ThemeNcode LLC's property.

Refund eligibility, including the 7-day money-back guarantee and the renewal-charge exception, is set out in the License Policy.

8. Acceptable use of the Site
When accessing tncflipbook.com, you agree not to:
- Use the Site in any way that violates applicable laws or regulations.
- Attempt to gain unauthorised access to the Site, our update servers, license validation infrastructure, or any related systems.
- Interfere with, disrupt, or place an undue burden on the Site or our infrastructure through automated scripts, scraping at scale, denial-of-service activity, or similar conduct.
- Impersonate ThemeNcode, our staff, or our products in communication with customers, support staff, the WordPress ecosystem, or the public.
Acceptable use of the plugin itself, including restrictions on how the product may be installed, modified, distributed, or used to host content, is covered in the License Policy.
9. Intellectual property and trademarks
All content on tncflipbook.com (other than the GPL-licensed plugin source and any user-submitted content) is owned by ThemeNcode LLC or its licensors, including but not limited to text, graphics, logos, images, demo videos, the design and layout of the Site, and the structure and styling of our documentation.
The names "TNC FlipBook", "TNC FlipBook 3D", "ThemeNcode", the TNC FlipBook logo, and any associated branding are trademarks of ThemeNcode LLC. You may not use our trademarks in any way that suggests endorsement, partnership, or that a derivative work is the official TNC FlipBook product, except for fair-use references in journalism, reviews, or comparable contexts.
10. Feedback, ideas, and user-submitted content
If you submit ideas, feedback, feature requests, bug reports, or content (including FlipBooks you have built, screenshots, or testimonials) through any channel, including the public ideas board at ideas.tncflipbook.com, support tickets, surveys, or email replies, you grant ThemeNcode a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and incorporate that material into our products and marketing.
You confirm that any content you submit is your own or that you have permission to share it, and that the submission does not infringe third-party rights. We do not claim ownership of the underlying work or trademarks you submit. We may reach out before publishing customer FlipBooks or testimonials in marketing materials to confirm permission and any required attribution.
11. Third-party services and integrations
Our products integrate with or support a range of third-party services, including payment processors, email service providers (Mailchimp, Brevo, MailerLite, ConvertKit, ActiveCampaign and others), AI providers (OpenAI, Anthropic, Google, Amazon, Microsoft, ElevenLabs), advertising networks, WooCommerce, and various WordPress plugins.
Your use of any third-party service through our plugin is subject to that service's own terms and pricing. ThemeNcode is not responsible for the availability, performance, accuracy, billing, or content of third-party services. If you use a third-party AI provider for the Read Aloud or Chatbot addons, you are responsible for that provider's API costs and for ensuring your use of the content complies with the provider's terms.
12. Privacy and data
How we collect, store, and process personal data is set out in our Privacy Policy. By using the Site or our products, you acknowledge that you have read and understood that policy.
If you are a controller of personal data processed by our products on your own site (for example, lead-capture email submissions, or analytics tracking visitors to your FlipBooks), you remain solely responsible for compliance with applicable data protection law, including providing your own privacy notices, obtaining consent where required, and honouring data-subject rights.
13. Disclaimers
The Site and all products are provided "as is" and "as available", without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty arising from course of dealing or trade usage.
We do not warrant that:
- The Site or products will be uninterrupted, error-free, or free of harmful components.
- The products will meet your specific requirements or be compatible with every combination of WordPress version, theme, plugin, hosting environment, browser, or third-party service in existence.
- Any errors or defects will be corrected, although we make reasonable efforts to do so.
You are responsible for maintaining current backups of your WordPress site and FlipBook content, and for testing changes in a staging environment before deploying them to production.
14. Limitation of liability
To the maximum extent permitted by law, ThemeNcode LLC, its directors, employees, contractors, and affiliates will not be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, loss of goodwill, or cost of substitute products, however caused and on any theory of liability (whether contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or relating to these Terms, the Site, or any product we sell will not exceed the amount you actually paid to us in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless ThemeNcode LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Site or our products in violation of these Terms, the License Policy, or applicable law.
- Content you publish using our products that infringes a third party's intellectual property, privacy, or other rights.
- Your breach of any representation or warranty in these Terms.
- Your interaction with any third-party service through our products, where the claim arises from your use rather than from our product itself.
16. Termination
You may stop using the Site and uninstall our products at any time. Subscription cancellation is handled through your account dashboard.
We may suspend or terminate your access to the Site, your account, or your license if you materially breach these Terms or the License Policy. Where reasonably possible, we will reach out before terminating to understand the situation and try to resolve it. Termination of a license for breach, and any associated pro-rata refund, is handled per the License Policy.
Sections of these Terms that by their nature should survive termination (including sections 9, 13, 14, 15, 17, and 19) survive any termination.
17. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and ThemeNcode agree that any dispute arising out of or relating to these Terms, the Site, or our products will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts. The parties may agree in writing to resolve a particular dispute through mediation or arbitration in lieu of court proceedings.
Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
18. Changes to these Terms
We may update these Terms from time to time. When we make a change that materially affects your rights or obligations, we will notify registered account holders by email and update the "Last updated" date at the top of this page at least 30 days before the change takes effect. Minor clarifications, typo fixes, and changes to contact details take effect when posted.
Your continued use of the Site or our products after a change takes effect constitutes acceptance of the revised Terms. If you do not agree with a change, your remedy is to stop using the Site and request a refund (within the eligible window described in section 6).
19. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
These Terms, together with the License Policy, the Privacy Policy, and any product-specific terms presented at checkout, constitute the entire agreement between you and ThemeNcode regarding the Site and our products, and supersede all prior agreements or communications on the subject.
Our failure to enforce a right or provision of these Terms is not a waiver of that right or provision.
